Biography

Abdoulaye Cissé joined LASPAD in February 2022 as a research assistant under the ProDP-AFRICA program. A doctoral student in private law at the Université Gaston Berger de Saint-Louis, he is currently project manager for seminars initiated by LASPAD.

Presentation

This thesis explores the political, legal and institutional frameworks for personal data protection in Africa, a crucial issue in the age of the information society. In a context marked by the rise of digital technologies and the strategic importance of personal data, the study sheds light on the complex processes and varied dynamics underpinning the development of public policies, laws and institutions responsible for protecting this data on the African continent.

The analysis is based on two main points: the diversity of approaches adopted by the various players involved in designing these frameworks, and the search for a unity of approach aimed at harmonizing existing initiatives. On the one hand, the plurality of players, including state institutions, international organizations, the private sector and civil society, leads to statutory and functional divergences. On the other hand, this diversity calls for concertation mechanisms to build an inclusive compromise adapted to African realities.

Case studies from Senegal, Morocco, Rwanda, South Africa and Chad illustrate governance issues, the challenges of harmonizing legal and institutional frameworks, and the tensions between economic, political and social interests. Ultimately, the report suggests ways to achieve effective and sustainable personal data protection in Africa, taking into account local specificities and international standards.
